Subordinate Legislation Committee considers Family Law (Scotland) Bill: Stage 1, 15/03/05 [S]

At their meeting on 15 March the Committee considered a response from the Executive on the delegated powers provisions in the Family Law (Scotland) Bill at Stage 1. The first of those was concerned with the proposed new section 3(1B) of the Children (Scotland) Act 1995 and the second with the short title and commencement of section 34 of the bill.

The Committee had shown concern that the power in proposed new section 3(1B) of the Children (Scotland) Act 1995 need not necessarily be as restricted as the Executive envisaged in the policy memorandum and could be used to extend parental responsibilities and rights to a father who had not registered anywhere as the father of the child. The Committee agreed to press for the power to be limited in the bill.

With regards to section 34 of the bill and the Committee agreed that the powers should be split between two statutory instruments.
